Privacy Policy for
3821 Digital Solutions LLC
Last Updated: May 19, 2025
Your privacy is important to us. This Privacy Policy explains how 3821 Digital Solutions LLC (referred to as “3821 Digital Solutions,” “Company,” “we,” “us,” or “our”) collects, uses, discloses, and safeguards your personal information when you use our website and web application (collectively, the “Services”). It also describes your rights and choices regarding your information. We are committed to handling your personal information in a safe and responsible manner, in accordance with applicable U.S. laws and regulations.
By accessing or using our Services, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with our practices, please do not use the Services. If you have questions or concerns, contact us at mpeterson@3821digitalsolutions.com.
1. Information We Collect
We collect personal information that you voluntarily provide to us, as well as some information automatically when you interact with our Services. The types of information we collect include:
- Contact Information: Such as your name, email address, phone number, mailing address, and business name. We collect this when you fill out forms on our site (for example, when you contact us, sign up for an account, subscribe to a newsletter, or request a consultation).
- Business Information: Details related to your business that you may provide, such as your company name, industry, size of company, and business goals or project details. For example, if you fill out a questionnaire or onboarding form, you might provide information about your business needs or current digital presence.
- Date of Birth: In certain cases, we may ask for your date of birth or confirmation of age. This is primarily to verify that you meet our age requirements (for instance, to confirm you are 18 or older, or to identify if a parent/guardian account is required for younger users). We do not knowingly collect dates of birth from anyone under 13 (see “Children’s Privacy” below).
- Social Media Credentials and Tokens: If you choose to integrate your social media accounts with our Services (for example, to allow us to post content on your behalf or analyze your social media engagement), we will collect the authentication credentials or “tokens” that allow us to access those accounts. This could include OAuth tokens or API keys from services like Facebook, Instagram, Twitter, LinkedIn, or others. We collect only the information needed to connect to those services – usually not your password itself, but a digital token provided by the social platform. We also may collect certain information from your social media profile (such as your username, profile picture, or statistics) only with your permission and only as necessary to provide the service you requested.
- Content You Provide: We collect any content that you upload or create through our Services. For example, if you draft social media posts, upload images, or write blog content using our platform, we will collect that content. Similarly, if you communicate with us (such as through emails, chat, or support tickets) or provide feedback/testimonials, we will collect the information you share.
- Usage Data and Analytics: When you use our website or app, we automatically collect information about how you access and use the Services (“Usage Data”). This includes:
- Device and Browser Information: Your device type, operating system, browser type, and browser settings.
- IP Address: Your device’s Internet Protocol address, which may be used to infer your approximate geolocation (e.g., city or state).
- Log Data: Information such as the pages you visit on our site, the times and dates of your visits, the links or buttons you click, the amount of time spent on pages, and other diagnostic data.
- Cookies and Tracking Technologies: We use cookies, pixels, and similar tracking technologies to collect information about your interactions with our Services. For example, cookies help us remember your preferences, keep you logged in, and understand how you navigate our site. (See the “Cookies and Tracking” section below for more details.)
- Analytics Information: We use third-party analytics tools (such as Google Analytics or similar services) to collect information about usage of our Services. These tools may use cookies or device identifiers to help us analyze user traffic and improve our content and user experience. The information collected through analytics is generally aggregated and does not directly identify individual users.
We may also receive information from third parties in some situations. For example, if you register or log in through a third-party account (like Google or Facebook), or if you interact with us on social media, those platforms might send us certain information about you (according to their privacy settings and policies). Additionally, if we partner with other companies or referral sources, they might provide your contact or business information to us (with your consent or as allowed by law).
Sensitive Personal Information: We do not actively seek to collect sensitive personal data such as Social Security numbers, government ID numbers, financial account passwords, or precise health or genetic data through our website. Payment card information, if provided for purchases, is handled directly by our payment processor (e.g., Stripe) and not stored on our systems. Please avoid submitting sensitive personal information through our general contact forms or chat.
2. How We Use Your Information
We use the personal information we collect for a variety of legitimate business purposes. The primary uses include:
- Providing and Improving Services: We use your information to operate, maintain, and provide you with the features and functionality of our website and web application. For example, we use contact and account information to register you as a user, log you in, and personalize your experience. We may use business and content information to deliver customized solutions, such as generating marketing content or setting up automations tailored to your needs. Usage data and analytics help us understand how our Services are used so we can improve design, features, and performance.
- Communicating with You: We use your contact information (email, phone) to communicate with you about your account and the Services. This includes sending you service-related announcements and administrative messages (e.g., account verification, technical notices, updates, security alerts). We may also respond to your inquiries, support requests, or feedback. If you have signed up for our newsletter or marketing communications, we will use your email to send you newsletters, promotional materials, or other information we think may be of interest to you. You can opt out of marketing emails at any time (see “Your Choices” below).
- Fulfilling Requests: If you request a consultation, demo, or any service offering, we use the information provided (like your contact and business info) to schedule and conduct the session (using tools like Calendly for scheduling or Zoom for virtual meetings, as needed). If you integrate social media accounts for us to post content, we use the provided tokens and content to publish posts on your behalf as instructed. If you make a payment for our services, we use the necessary information to process that transaction (via our third-party payment processor).
- Internal Analytics and Research: We use aggregated and de-identified usage data to analyze trends and performance of our Services. This helps us troubleshoot issues, develop new features, and make informed decisions about our business. For example, we might analyze which features are most used by customers or which blog articles get the most traffic, so we can focus our efforts accordingly.
- Security and Fraud Prevention: We may use personal information (such as IP addresses or account activity) to monitor for and prevent fraud, security threats, or other illegal or malicious activity. This includes detecting and protecting against suspicious or unauthorized account activity, enforcing our Terms and Conditions, and otherwise ensuring the integrity and safety of our platform.
- Legal Compliance: We may process your personal data as required to comply with applicable legal obligations, government requests, or regulatory requirements. For instance, we might retain and disclose certain information if necessary to fulfill tax and accounting rules, to respond to lawful subpoenas or court orders, or to meet data retention obligations under law.
- Protecting Our Interests: Where necessary, we will use information to enforce our agreements (including this Privacy Policy and our Terms), to resolve disputes, to carry out collections for unpaid amounts, or to investigate and defend ourselves against any third-party claims or allegations.
- Other Purposes (with Notice to You): If we intend to use your personal information for a purpose that is materially different from the purposes listed in this Privacy Policy, we will provide you with additional notice or request your consent as required by law. For example, if we ever wanted to use a customer testimonial or case study that includes your personal information, we would reach out to you for permission before doing so.
We will only use your personal information in ways that are compatible with the purposes for which we collected it, or for other purposes that you subsequently authorize. We do not engage in automated decision-making or profiling that produce legal or similarly significant effects without human involvement, except as needed to provide the core functionality of our Services as directed by you (for example, automatically scheduling a social media post you’ve created for a specified time).
3. How We Share Your Information
3821 Digital Solutions values your privacy. We do not sell your personal information to third parties for their own marketing or profit. We share your information only in the following circumstances, and always with safeguards to protect your data:
- With Service Providers: We share personal information with trusted third-party service providers and partners who perform services on our behalf, only to the extent necessary to carry out their functions. Examples of service providers include:
- Payment Processors: For handling transactions (e.g., Stripe). If you make payments through our Services, your credit card number and payment details go directly to Stripe. Stripe’s use of your data is governed by their privacy policy, and they are not allowed to use your payment information for any purpose other than facilitating payments on our behalf.
- Scheduling and Communication Tools: For arranging meetings or communications (e.g., Calendly for scheduling appointments, Zoom for video calls, or email service providers for sending messages). These providers get access to details like your name, email, and meeting details when necessary to provide the service (for instance, Calendly will receive the information you input to schedule a meeting, and Zoom will receive your name/email to set up a call).
- Social Media Platforms: If you connect a social media account to our platform, we will share data with that platform as needed to post content or retrieve data. For example, if you schedule a post to Facebook through our Service, we transmit the content of the post (and necessary authentication token) to Facebook. This is done securely via the platform’s API. The social media platform will process your data according to their own privacy terms.
- Analytics and Performance Tools: We may share certain online identifiers or device data with analytics services like Google Analytics to understand usage of our Services. These third parties use the data strictly to provide us with analytics and insights (e.g., how many users visit a page, how users navigate the site).
- Other Vendors: We may use other vendors for functions like web hosting, data storage, cloud services, customer relationship management (CRM), or marketing email distribution. These vendors might process data such as your contact info or usage data while performing their tasks for us. We require our service providers to handle personal information in a confidential and secure manner and not use it for any purposes other than as instructed by us.
- Within Our Corporate Family: If 3821 Digital Solutions LLC has affiliates, parent, or subsidiary companies in the future (for instance, if we form related entities or are acquired), we may share your information within that corporate group if necessary, consistent with this Privacy Policy. All recipients will be bound to maintain that information in accordance with this policy.
- Business Transfers: In the event of a prospective or actual business transaction such as a merger, acquisition, financing, sale of assets, or transition of service to another provider, your personal information may be disclosed or transferred to the other organization as part of that deal. We will seek to ensure that any such successor entity is bound by similar privacy standards and that you are notified of any ownership change affecting your personal information.
- Legal Requirements: We may disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to:
- Comply with a legal obligation, such as responding to subpoenas, court orders, or lawful requests by government authorities.
- Protect and defend the rights, property, or safety of 3821 Digital Solutions, our customers, or others. This includes enforcing our Terms and Conditions or other agreements, or investigating potential violations thereof.
- Detect, prevent, or address fraud, security, or technical issues.
- Cooperate with law enforcement or regulatory agencies in investigations or matters of public safety (consistent with applicable law).
- With Your Consent: Aside from the cases listed above, we will only share your personal information with third parties when we have your explicit consent to do so. For example, if we wanted to feature your success story on our website, we would ask for your permission before sharing any identifiable details publicly. Or if an outside consultant or partner needs information to assist with your project, we would only share that if you agree.
In all sharing scenarios, we strive to disclose only the minimum information necessary to achieve the intended purpose. We also require any third parties with whom we share personal data to provide an adequate level of security and to use the data only for the agreed-upon purpose, consistent with this Privacy Policy and applicable law.
4. Cookies and Tracking Technologies
Like many online services, we use cookies and similar tracking technologies to collect usage information, remember preferences, and improve user experience. This section explains what these technologies are and how we use them:
- What Are Cookies? Cookies are small text files that are placed on your device (computer, smartphone, etc.) when you visit a website. They allow the website to recognize your device and store information about your preferences or past actions. Cookies can be “session” cookies (which expire when you close your browser) or “persistent” cookies (which remain on your device for a set period or until you delete them).
- How We Use Cookies: 3821 Digital Solutions uses cookies for several purposes, including:
- Essential Cookies: These are necessary for the website or app to function properly. For example, they may allow you to stay logged in as you navigate through secure areas of the site, or help load the pages faster. Without these cookies, certain features may not work.
- Preference Cookies: These cookies remember your preferences and settings to enhance your experience. For instance, they might store your language preference or remember form information so you don’t have to re-enter it.
- Analytics Cookies: We use analytics or performance cookies to collect information about how users interact with our site. This helps us understand which pages are popular, how long users stay, and if they encounter errors. The data is usually aggregated and doesn’t directly identify individuals. We use this to make improvements to site structure and content.
- Advertising/Tracking Cookies: At present, we do not use third-party advertising networks that track you across different sites for targeted advertising (and we do not serve third-party ads on our site). However, if in the future we did partner with advertising or remarketing services, those cookies would be used to show you relevant ads on other sites based on your activity on our site. If we ever introduce such cookies, we will update this policy and provide you with an opportunity to opt out.
- Web Beacons and Pixels: In addition to cookies, we may use tiny graphics called web beacons or pixels on our site or in emails. These are small pieces of code that can track actions like whether an email was opened or whether a certain page was viewed. This information helps us gauge the effectiveness of our communications and marketing campaigns.
- Third-Party Tracking: Some third-party services that we use (such as Google Analytics or embedded content like YouTube videos or social media plugins) may set their own cookies or similar tracking technologies when you visit our site. These third parties may collect information about your online activities over time and across different websites. For example, Google Analytics cookies allow Google to collect information about visitors to our site in order to provide us with reports. We use IP anonymization with Google Analytics to reduce the identifiability of our visitors. Please refer to the privacy policies of those third-party services for details on how they handle collected data.
Your Choices for Cookies: You have the right to decide whether to accept or reject cookies (aside from those strictly necessary for the operation of the site):
- Browser Controls: Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies or alert you when a cookie is being placed. Consult your browser’s help menu for instructions on how to manage cookies. Keep in mind that disabling certain cookies may affect the functionality of our Services. For example, if cookies are disabled, you may not be able to stay logged in or some interactive features might not work as intended.
- Opt-Out Options: For analytics, you can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on, which prevents your browser from sending information to Google Analytics. For any interest-based advertising (should we engage in it later), you can often opt out via industry organizations like the Digital Advertising Alliance (DAA) or Network Advertising Initiative (NAI) websites. We will provide relevant opt-out links if and when such advertising cookies are in use.
- Do Not Track: Our site currently does not respond to “Do Not Track” (DNT) signals because there is no uniform technology standard for DNT signals as of the last update of this Policy. We will continue to monitor developments around DNT browser technology and re-evaluate our practices if a standard is established.
By using our Services without disabling cookies, you consent to our use of cookies and similar technologies as described above.
5. Data Security
3821 Digital Solutions takes reasonable measures to protect the security of your personal information. We implement a combination of technical, administrative, and physical safeguards designed to preserve the integrity and security of data collected through our Services. These measures include:
- Encryption: We use encryption (HTTPS/TLS) to protect data transmitted between your browser and our website. This helps ensure that personal information (such as login credentials or form submissions) is securely transmitted.
- Access Controls: We restrict access to personal information to authorized personnel who need it to perform their job duties. Our team members and contractors are bound by confidentiality obligations and trained on data protection.
- Secure Hosting: Our website and databases are hosted with reputable providers that maintain robust security practices (such as firewalls, intrusion detection systems, and regular security patching).
- Monitoring: We monitor our systems for possible vulnerabilities and attacks, and we perform regular security assessments to identify and address potential weaknesses.
- Anonymization: Where possible, we anonymize or pseudonymize personal data in our analytics and logs to reduce the risk to your privacy in case of unauthorized access.
- Data Retention and Minimization: We only keep personal data for as long as reasonably necessary for the purposes described in this Policy (see “Data Retention” below), and we limit access to archived data.
Despite our efforts, please note that no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee absolute security of your data. You also play a role in protecting your information by keeping your account credentials confidential and taking common-sense steps like logging out of shared devices and avoiding phishing scams. If you have reason to believe that your interaction with us is no longer secure (for example, if you suspect your account has been compromised), please contact us immediately.
In the unlikely event of a data breach that affects your personal information, we will notify you and the appropriate authorities as required by applicable law. We will act promptly to mitigate the breach and to protect your information to the best of our ability.
6. Data Retention
We will retain your personal information for as long as necessary to fulfill the purposes for which it was collected, as outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. The criteria used to determine our retention periods include:
- Account Information: For active accounts, we retain your information for as long as your account is in use or as needed to provide you with services. If you deactivate or request deletion of your account, we will delete or anonymize your personal information within a reasonable period after your request, except for information we are required or permitted to retain by law (see below).
- Service Usage: We may retain certain data about your use of the Services for internal analysis purposes. Usage data that is aggregated or de-identified (and not linked to an identifiable user) may be retained longer than personal data, as it no longer identifies you and is used for analytics and improvement of our Services.
- Legal and Business Purposes: We might need to retain certain information for longer periods if necessary for legal compliance or legitimate business purposes. For example:
- Financial Records: Transaction records, invoices, and payment history may be kept for accounting and tax obligations (often for a minimum of 7 years, depending on U.S. tax law requirements).
- Legal Holds: If we are involved in litigation or receive a legal request, we may preserve relevant information until the matter is resolved, even if it exceeds our typical retention schedule.
- Contractual Obligations: Information related to contracts or services you have with us might be retained for the duration of the contract and for a reasonable time thereafter to address any post-contract issues or inquiries.
- Security Records: Logs and records related to security, fraud prevention, and account sign-in history may be kept to help us detect and prevent future incidents.
- Backups: Please note that residual copies of your personal information might remain in our backup systems for a short period after deletion, due to the nature of those systems. However, such backups are maintained in a secure manner and are only accessed if needed for disaster recovery.
Once the retention period expires, and we have no ongoing legitimate business need or legal obligation to keep your data, we will securely destroy, delete, or anonymize your personal information. When anonymized, information will no longer be associated with you and may be used by 3821 Digital Solutions for analytical or historical purposes without further notice.
7. Your Rights and Choices
We respect your rights regarding your personal information. Depending on your location and applicable U.S. state laws, you may have some or all of the following rights:
- Access and Correction: You have the right to request access to the personal information we hold about you and to obtain a copy of it in a portable format. You also have the right to request that we correct or update any inaccurate or incomplete personal information. Most of the time, you can review and update your account information directly by logging into your account settings. For any data not accessible via your account, you can contact us to request access or changes.
- Deletion (Right to Erasure): You can request that we delete the personal information we have collected from you. We will honor deletion requests to the extent required by applicable law. Please note that there are some situations where we cannot fully comply, such as when the information is necessary to complete a transaction you requested, to detect security incidents, to comply with a legal obligation, or for other reasons allowed by law. If full deletion is not possible (for example, due to legal retention requirements), we will let you know and, if required, will block use of that data for any other purpose.
- Opt-Out of Marketing Communications: If you have subscribed to our newsletter or otherwise receive marketing emails from us, you have the right to opt out at any time. You can click the “unsubscribe” link in any promotional email, or contact us at mpeterson@3821digitalsolutions.com and request to be removed from our marketing list. Please note that you will still receive administrative emails (for example, those related to your account, transactions, or legal updates) even if you opt out of marketing messages.
- Opt-Out of Data Sharing/Sale: We do not sell personal data, but if you are a resident of California or another state with similar laws (e.g., Virginia, Colorado, etc.), you have the right to direct a business not to sell or share your personal information. Since we do not sell data, this is not applicable. If we ever were to engage in any practice considered a “sale” or certain types of “sharing” under state law, we would implement a mechanism for you to opt out as required.
- Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights. For example, we won’t deny you services, give you a different level of service, or charge you a different price because you exercised your rights under applicable law.
- Authorized Agents: If you are making a request on behalf of another person (as an authorized agent, legal guardian, or under power of attorney), we may require proof of your authorization and may also require the individual to verify their identity directly with us, as permitted by law.
How to Exercise Your Rights: To exercise any of the rights described above, please contact us via email at mpeterson@3821digitalsolutions.com or by phone at (970) 690-6655. Please include your name, contact information, and a detailed description of your request. We may need to verify your identity before fulfilling your request (to ensure we don’t disclose or delete data to the wrong person). Verification may involve confirming information we already have on file for you, and in certain cases, we might ask for additional identification.
We will respond to legitimate requests within the timeframes required by law (generally within 30-45 days for most requests, and we will notify you if we need an extension). If for some reason we cannot fulfill your request, we will provide an explanation subject to any legal restrictions.
8. Children’s Privacy
Our Services are not intended for children under the age of 13. We do not knowingly collect personal information from children under 13 years old. If you are under 13, do not use or provide any information on our website or through our Services. We also require that users under 18 have a parent or guardian manage their use of our Services (as described in our Terms and Conditions).
If we learn that we have inadvertently collected personal data from a child under 13 (or equivalent minimum age under applicable law) without proper consent, we will take steps to delete that information as soon as possible. If you are a parent or guardian and you believe that your child under 13 may have provided personal information to us, please contact us immediately at mpeterson@3821digitalsolutions.com so that we can investigate and address the issue promptly.
For minors between 13 and 17 years old who are using our Services under the supervision of a parent or guardian: We collect only the information necessary for the use of the Services (such as the minor’s name and contact if needed, and any content they create). The parent or guardian’s information (for account ownership, billing, etc.) will also be collected as described in this Policy. Parents/guardians can review and request deletion of the minor’s personal information at any time by contacting us. If a minor user turns 18, the individual can take ownership of the account by contacting us and updating the account registration information.
We comply with the Children’s Online Privacy Protection Act (COPPA) and other relevant laws for youth privacy. Our approach is to avoid the collection of data from young children altogether by not offering services to them. We urge all minors (under 18) to obtain their parent or guardian’s permission before sharing any personal information online.
9. Do Not Sell or Share My Personal Information (California Notice)
While 3821 Digital Solutions does not sell personal information in the traditional sense (we do not exchange data for money with data brokers or third parties for their independent use), California law (CCPA/CPRA) has a broad definition of “sell” and “share” that can include some data sharing practices for advertising or analytics purposes. We want to clarify our practices in this regard:
- Sales: We do not sell your personal information to third parties. We do not provide personal data to third parties for their own direct marketing or commercial purposes.
- Sharing for Targeted Advertising: We currently do not share personal information with third parties for cross-context behavioral advertising (targeted advertising) purposes. In other words, we don’t disclose your data to ad networks or social media companies for the purpose of showing you ads on non-3821 Digital Solutions websites or services.
- Analytics and Service Providers: The only instances where personal data might be disclosed to third parties are those described in Section 3 (How We Share Your Information) – such as with our service providers for business purposes. These disclosures (for example, to a cloud hosting provider or an analytics service) are governed by contracts that prohibit the recipients from using the data for any purpose other than to provide services to us. Under CCPA, these kinds of disclosures for business purposes are not considered “sales.” We treat our service providers and partners as extensions of our own services, and they are obligated to confidentiality and proper data handling.
If in the future we engage in any practice that falls under the definition of selling or sharing personal data under California law, we will update this Privacy Policy and provide a clear “Do Not Sell or Share My Personal Information” option on our website, as well as honor any global privacy control signals as required.
California residents have the right to opt out of the sale or sharing of their personal information. Since we do not sell or share data in that manner currently, there is no mechanism needed for opting out. However, if you have any questions or concerns about our data practices or your rights under California law, please contact us.
Additionally, California law provides California residents with certain other rights, which we’ve discussed in the “Your Rights and Choices” section, including the right to know what categories of personal information we collect, for what purposes, the categories of sources, and the categories of third parties to whom we disclose data. Those details are all provided in this Privacy Policy. We will also provide a California Privacy Notice upon request that summarizes these points in compliance with CCPA/CPRA requirements.
10. External Links and Third-Party Services
Our website and Services may contain links to third-party websites or services that are not operated by 3821 Digital Solutions (for example, links to articles on our blog that direct to external sites, or embedded videos from YouTube, or social media widgets that take you to our pages on other platforms).
Please note: This Privacy Policy applies only to information collected by 3821 Digital Solutions through our own Services. If you click a link to a third-party site or use a third-party service (even one that may be connected to our platform), you will be subject to that third party’s privacy policy and practices. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
For example, if you schedule a meeting via a Calendly link on our site, Calendly may collect data in accordance with its own privacy policy. If you join a Zoom call, Zoom’s privacy terms apply to data you provide to Zoom. If you follow us on social media or interact with our social media profiles, any information you share on those platforms is governed by those platforms’ policies.
We encourage you to review the privacy policies of every website or service you visit or use, especially before providing any personal information. If you have questions about how our partners or third-party services handle your data, please read their privacy notices or contact them directly.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we update the policy, we will revise the “Last Updated” date at the top. For significant changes, we will provide a more prominent notice — for example, by posting a notice on our website’s homepage or by emailing registered users (if the changes materially affect your rights or how we use your data).
Your Responsibility to Review Updates: We encourage you to periodically review this Privacy Policy to stay informed about how we are protecting the personal information we collect. Your continued use of the Services after any changes to this Policy signifies your acceptance of the updated terms, to the extent permitted by law.
If you do not agree with any changes to the Privacy Policy, you should stop using our Services and may request that we delete your personal information (as per Section 7, Your Rights and Choices).
